Senate Republicans Unveil Final CLARITY Act with 126 Key Changes Requested by Democrats

In a significant development for the digital asset landscape, Senate Republicans have released the final draft of the CLARITY Act, which incorporates 126 changes requested by Senate Democrats. This bipartisan effort aims to reshape the regulatory framework governing digital assets, focusing on enhanced oversight by the SEC and CFTC.

The revisions modify key aspects such as token classifications, issuer disclosures, and compliance rules for exchanges and decentralized finance (DeFi). Notably, the act narrows issuer exemptions and imposes stricter fundraising limits, reducing the annual cap from $75 million to $50 million.

Among the changes, the act introduces a new Network Token framework, which requires issuers to certify their assets as ancillary rather than securities for public resale. Additionally, it expands anti-evasion measures and mandates delisting for certain disclosure violations.

Another critical area of focus is the classification of digital asset intermediaries as financial institutions under the Bank Secrecy Act, enhancing compliance requirements and protections for users of crypto ATMs. The act also aims to tighten regulations on meme coins and non-fungible tokens (NFTs), allowing the CFTC to oversee their trading.

As the Senate prepares for a crucial vote on September 15, the outcome will determine whether lawmakers can advance the measure further. The proposed changes reflect a significant shift in digital asset governance, emphasizing the need for clarity and compliance in an evolving market.
