Japan Authorities To Enforce New Crypto Regulations From 1st May
To regulate the crypto industry in Japan, the Japanese House of Representatives has passed two legislation. According to reports, these legislations were planned to bring in effect at the start of April but as there were unexpected delays, the date of enforcement was announced last week. The new regulations for cryptocurrencies will be implemented at the start of the next month, .i.e. May. Till now there were no precise laws for crypto regulations in Japan.
As per the announcement, the Payment Service Act (PSA) and Financial Instruments and Exchange Act (FIEA) have been revised and will be implemented from May month. With the motive to regulate cryptocurrencies in Japan, the changes were made in existing laws. The new law demands crypto exchanges with cryptocurrency trading prices live, working in the country to separate users' money from their own cash flows. Also, the terminology has been changed from “virtual currency” to “crypto asset.”
The new regulations state that if a user had kept crypto assets in the hot wallet of the crypto exchange, they have to maintain the same amount of crypto assets in reverse so in case of a hack the exchange repays to a user.
With these new laws for crypto, Japan can grow its crypto industry among other Asian countries. Japan with its FIEA and PSA regulations can stand out as a haven for crypto. To deal with initial coin offerings (ICOs) and security token offerings (STOs), electronically recorded transferable rights (ERTRs) concept has been used under FIEA. From 1st May crypto-asset derivatives transactions will be regulated under the FIEA.
There are many other countries that are working on enforcing the Financial Action Task Force (FATF) guidelines to regulate cryptocurrencies.
