Australian Florist Won A Domain Name ‘Binance’
The leading crypto exchange Binance just lost a domain name dispute with Australian florist, Binance.
Binance exchange had claimed that they had registered its trademark in Australia nearly one year before the florist registered its domain name.
As per the report by news outlet Forklog, Binance was represented by Ashurst Australia and stated that the Binance trademark was registered on 21st November 2018 while florist had registered it on 27th October 2019.
WIPO, the organization responsible for domain name disputes dismissed Binance claims as it stated that cryptocurrency exchange “has not discharged its onus of demonstrating the Respondent does not have rights or legitimate interest in the disputed domain name.”
The exchange points out that the Binancé’s director, Mr. Nawodycz also manages a digital marketing firm and works as a “blockchain exchange researcher” for the company ‘ World Bookings’ — insinuating that Nawodycz registered the name for the sole purpose of monetizing the domain.
WIPO denies the claim of Nawodycz stating that ‘binancé flowers’ does not translate from French to mean ‘paired flowers’ in English — as was claimed by Nawodycz. Although, Google translate was found to support Nawodycz’s assertion.
The plans and expenditure estimates provided by Nawodycz were without a date and could have been created at any time.
WIPO’s judgement also noted that the images listed on Binance.com.au were similar to those used by various eBay and Etsy sellers and the MetaMask browser extension flags the site as a phishing attempt.
