As of October 1, 2026, Alabama has enacted new regulations aimed at safeguarding victims of crypto ATM scams. Under the Cryptocurrency Kiosk Fraud Prevention Act, operators are now required to reimburse qualifying losses incurred by users.
New customers who fall victim to scams are entitled to full refunds, including any associated fees, while existing customers can recover half of their transaction value. This initiative is part of a broader effort to enhance consumer protection in the rapidly evolving cryptocurrency landscape.
To qualify for these refunds, victims must report the incident to the kiosk operator, law enforcement, and the Alabama Securities Commission (ASC) within 60 days of the transaction. This reporting process is crucial for addressing losses and preventing future scams.
In addition to refund requirements, the new law imposes transaction limits to curb fraudulent activities. New users are restricted to a maximum of $1,000 per day and $10,000 per month, while existing customers have a slightly higher daily limit of $10,500.
Operators must also provide clear disclosures regarding fees and exchange rates before processing transactions, ensuring that customers are fully informed. These measures aim to combat the growing threat of scams that often exploit unsuspecting individuals.
Alabama's proactive approach follows a concerning trend of crypto-related fraud, with the FBI reporting nearly $3 million in losses related to kiosk scams in the state last year. While these regulations are a step forward, officials emphasize that ongoing vigilance is necessary to combat fraud effectively.
